TORONTO -- The Federal Court has ruled against a motion which would have allowed the music industry to begin suing individuals who make music available online.

Justice Konrad von Finckenstein ruled Wednesday that the Canadian Recording Industry Association did not prove there was copyright infringement by 29 so-called music uploaders.

He said that downloading a song or making files available in shared directories, like those on Kazaa, does not constitute copyright infringement under the current Canadian law.

Last month, the industry association took five Internet service providers to Federal Court, trying to force the companies to hand over the names and addresses of 29 people who allegedly shared hundreds of songs with others using programs like Kazaa last November and December.

The judge denied the recording industry's request, which means high-speed Internet providers won't have to divulge their client list.

Without the names, CRIA can't begin filing lawsuits against 29 John and Jane Does who it alleges are high-volume music traders.

They're currently identifiable only through a numeric Internet protocol address and user handles like Jordana@KaZaA.

Last time, Microsoft's source code leaked out, a number of ISPs in Australia received strong worded letters from Microsoft's lawyers demanding ISPs to request their users to delete those files.

That was another issue, back music...

I would gladly purchase music online via Napster or iTunes, but there are just very few decent online music stores in Australia (You need to be in US or Canada).

i don't know about dustin, but right now i have my truck tore apart and rebuilding the rear and front end, so i have no money for music, thats why i download illegally

If I can get the music for free why would I pay for it!!

Think about it everyone was stealing music before the music industry started to catch onto it, and no one was complaining then so why should you complain now?

for god sakes man, until up to a year ago it wasn't stealing, I can't afford to pay $1 a song what do you think I am made of money, I live on a farm!! Any way it is still legal in Canada and until it isn't I will keep downloading music.

Are you calling other people who buy music "stupid"?

It has always been called "stealing".

I am sure Canada Government do not tell people to "come to Canada and steal music".

I do not download all of my music, I do buy some, so still I am supporting the industry, but If you think about it some where along the line someone did pay for that music, so technically it's not stealing, also what ever music I buy I allow to be uploaded on Kazza so eventually it all goes around.

The music you bought you only gain the right to play it for your "personal" enjoyment.
You do not own the copyright of the music.
You do not have the right to (re-)distribute it.
You are not even allowed to play it in public places.
